These Terms of Service (“Terms”) govern your access to and use of the online content and services Pedcor Companies, including Pedcor Management Corporation and Pedcor Homes Corporation, and its subsidiaries (“Pedcor” or “we” or “us” ) provide you at https://www.pedcorcompanies.com, https://www.pedcorliving.com, and https://www.pedcorhomes.com, and their subdomains (our “Websites”).
By accessing or using our Websites, you agree to be bound by these Terms and that you are at least 18 years old. If you use our Websites to apply for an apartment, or to access our Resident Portal after you have become a resident of one of our apartments, you will be required to agree to additional terms, including agreeing to electronic signature, credit checks, and online rent payments. Such agreements are hereby incorporated into these Terms, as are Pedcor’s Privacy Policy and Statement, Text Messaging Terms of Conditions, and any other terms, when applicable.
If you agree to these Terms, we grant you a non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use our Websites in accordance with the Terms. If you disagree with any part of these Terms, you may not access or use the Websites.
Your Use of the Websites
You agree that:
- You will use the Websites as intended,
- You will not impersonate any person or entity on the Websites,
- You will not access or use the Websites for any fraudulent or unlawful purpose, including conduct that may violate somebody else’s privacy or intellectual property rights,
- You will not attempt to modify or disrupt the Websites, including by introducing any virus or other harmful computer code to the Websites,
- The information you provide to the Websites (for example, the information you provide us in the Contact Forms) is true, accurate, and complete to the best of your knowledge, and
- If you have a Resident Portal account, you will safeguard your username and password, you will not share your account information or give others access to your account, and that you will keep your account information current. You are responsible for any consequence resulting from your failure to keep your username and password secure.
Content of the Websites
The Websites may change over time as we change and add more features or content. We reserve the right to update, modify, or discontinue the features, functionality, content or other aspects of the Websites, with or without notice, in our sole discretion. Any new features that augment or enhance the current Websites shall be subject to these Terms.
Our Use of Your Comments and Feedback
When you submit questions, comments, or other feedback to our Websites, you give us a right and license to use your content for any lawful purpose, including commercial purposes and advertising. For example, we might feature your comment in promotional or marketing materials to help prospective residents better understand Pedcor’s services.
Third Party Sites
Our websites may contain links or connections to third party websites or services that are not owned or controlled by Pedcor. We have no control over, and assume no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third-party websites or by any third party that you interact with through the Websites. You release and hold us harmless from any and all liability arising from your use of any third-party website.
Disclaimers
We provide the Websites on an “as available” or “as is” basis. While we strive to keep them updated and operational, the Websites may not always be available and may, sometimes, display inaccurate or outdated information. Nor can we guarantee that the Websites will be free of viruses or other destructive code. To the fullest extent permitted by law, we make no warranties, implied or express, about the content or services we provide on the Websites, and we disclaim any warranties of merchantability, fitness or a particular purpose, and non-infringement. We will not be liable for any damage or loss that results from your access or use of the Websites.
Dispute resolution
If a dispute or disagreement arises between you and us related to your access or use of the Websites, you agree to contact us at to privacy@pedcor.net and attempt to resolve the dispute or disagreement informally. In the unlikely event we are not able to resolve the dispute or disagreement within 60 days, you and Pedcor agree that any judicial proceeding to resolve a claim will be brought in the federal or state courts in Hamilton County, Indiana. Both you and Pedcor consent to venue and personal jurisdiction in such courts.
Amendment of Terms
We may amend these Terms from time to time. If we do, we will publish an updated version on the Websites. Amendments will take effect as soon as they are published and from then on will govern your access and use of our Websites. If you do not agree with the amended Terms, you should not continue to use the Websites after the date on which the amendments are published.
